§ 163-46. Regulations and restrictions.
The following regulations shall apply during snow emergencies:
A. It shall be unlawful for any person to park a vehicle or to allow the same to remain parked on any permanent snow emergency street or on any temporary emergency street posted as such.
B. Any vehicle that shall become stalled, incapable of moving under its own power or left unattended upon any traffic lane of any snow emergency street shall be deemed to be operated and/or parked in violation of this article, and the owner or operator of such vehicle shall be guilty of a violation of this article.
C. Borough authorities may remove, by any means authorized by law, any vehicle parked in violation of this article or stalled or otherwise inoperative upon any snow emergency street, as herein prohibited, which is constituting an extreme hazard to public safety and/or which jeopardizes the orderly performance of snow emergency functions by the borough's Public Works Section.
D. It shall be unlawful at any time for any person to operate any motor vehicle on any such snow emergency route or street, unless that vehicle is for emergency purposes. Said prohibition shall apply to all streets of the borough and shall subject the owner of the vehicle to a fine of $100. [Added 11-15-1999 by Ord. No. 770]
E. This chapter shall not prevent the operation of any motor vehicle or tractor by the Commonwealth of Pennsylvania or any of its agents or employees who are involved in snow removal operations. [Added 11-15-1999 by Ord. No. 770]
F. This chapter shall not prohibit any individual from using the highway if it is lawful to do so during a snow emergency declared by the Mayor of the borough. [Added 11-15-1999 by Ord. No. 770]
G. This chapter shall not prohibit any person or corporation that is a licensed contractor for purposes of snow removal in Sayre Borough and has proper vehicle insurance, liability insurance, proper motor vehicle license and a properly inspected vehicle who has previously submitted the snow routes in which it intends to operate from being allowed by the Mayor to operate to remove snow during a declared snow emergency. H. Said licensee or motor vehicle operator shall apply to the Mayor of the borough for the permission to operate during a snow emergency, and said Mayor's approval shall be contingent upon the requirements set forth in the above-mentioned subsection. In the event that the Mayor rejects the application of a licensed contractor to operate during a snow emergency, the applicant shall have a right to appeal said decision of the Borough Council, which shall vote thereon after a hearing is afforded to the licensed contractor. § 163-47. Violations and penalties. [Amended 11-15-1999 by Ord. No. 770]
Any person who shall violate any of the provisions of this article shall, upon conviction thereof, be sentenced to pay a fine of up to $300, plus costs of prosecution and, in addition, any other costs incurred by the borough in removal of said vehicle, and in default of payment of such fines and costs, to imprisonment in accordance with the provisions of law.
